Damage, Theft & Breakdown Policy
What to do and who is responsible if a rented vehicle is damaged, stolen, lost, or breaks down.
If Something Goes Wrong
Contact MK Rides straight away for any accident, damage, theft, loss or breakdown. For theft or loss, also report the incident to the appropriate authorities.
- Contact MK Rides or the designated field executive immediately.
- For theft or loss, report the incident to the appropriate authorities as well.
- Do not undertake or authorise repairs without MK Rides’ approval, unless immediate action is reasonably necessary for safety or required by law.
- Cooperate with the assessment and documentation process.
Accidents and Vehicle Damage
If a rented vehicle is damaged due to an accident, misuse, negligence, or a breach of the rental terms, the customer may be held liable for the reasonable and applicable repair costs, subject to the rental agreement, insurance coverage, and applicable law.
Where the vehicle becomes unavailable for rental due to such damage, any additional compensation or loss-of-use charges must be determined in accordance with the agreed rental terms and applicable law and communicated to the customer.
Customers must promptly inform MK Rides of any accident or damage and cooperate with the necessary assessment and documentation process.
Helmet Damage
Helmets are provided by MK Rides free of charge for both the rider and the pillion. Other safety gear such as gloves, knee guards and riding jackets is available at separate charges.
Customers are responsible for taking reasonable care of any helmet provided with the rented vehicle. In the event of damage beyond normal wear and tear, applicable repair or replacement charges may be levied in accordance with the disclosed rental terms.
Theft or Loss
In the event of theft or loss of a rented vehicle, the customer must immediately notify MK Rides and report the incident to the appropriate authorities.
The customer’s financial responsibility, if any, will be determined in accordance with the rental agreement, applicable insurance coverage, the circumstances of the incident, and applicable law. Any compensation for vehicle loss must be assessed on a lawful and documented basis.
Breakdown and Mechanical Failure
If the rented vehicle develops an engine fault or another mechanical problem during the rental period, the customer must immediately contact MK Rides or the designated field executive.
Customers must not undertake or authorise repairs without prior approval from MK Rides, except where immediate action is reasonably necessary for safety or required by law.
Where a vehicle must be replaced due to a verified mechanical fault, MK Rides will make reasonable efforts to provide a replacement vehicle, subject to availability and the applicable rental terms.
Unsafe or Prohibited Riding
Operating a rented vehicle under the influence of alcohol, narcotics, or any substance that impairs driving ability is strictly prohibited. Customers must not engage in reckless driving, racing, stunts, or other unsafe or unlawful activities.
Where an accident, damage, or loss occurs in connection with intoxicated or prohibited riding, the customer’s liability will be determined under the rental agreement, applicable insurance terms, and applicable law. MK Rides does not guarantee insurance coverage for incidents arising from prohibited conduct.
Traffic Fines and Penalties
Any traffic challans, fines, or penalties arising from the rider’s conduct during the rental period will be the rider’s responsibility. Customers must pay the relevant issuing authority directly or reimburse MK Rides where it has lawfully paid an amount on the customer’s behalf. This includes overspeeding, signal jumping, wrong parking, riding without a helmet, triple riding and other traffic violations. Verified challans, including online challans issued or discovered after the vehicle has been returned, remain payable by the responsible customer, who must pay the actual challan amount immediately on notification and provide any information MK Rides requires.
Repair Charges, Evidence and Deposit
- Repair charges are based on a workshop estimate, invoice, parts cost or other reasonable supporting evidence. The customer may request a copy of the supporting documents. No arbitrary damage penalty will be imposed in place of an actual, supportable assessment.
- If damage is found during the rental period or at return, the customer must pay the assessed repair cost immediately, based on a repair estimate, workshop quotation or invoice. If the final cost cannot be determined immediately, a documented provisional amount may be agreed upon, followed by a final adjustment against the actual repair cost.
- Minor damage may be deducted from the refundable security deposit, provided the damage and reasonable repair cost are documented. If the damage exceeds the available deposit, the customer must pay the remaining amount.
- For major damage, an accident, or damage to the engine, chassis, suspension, wheels or other major components, the customer must immediately inform MK Rides. The customer is liable for documented losses legally recoverable under the rental agreement, subject to applicable law and insurance terms.
- Damage from rash driving, careless handling, overloading, riding on unsuitable roads, unauthorised modifications, water damage caused by misuse or other negligent use may be charged according to the actual assessed repair cost.
- Damage caused by continued driving after a warning or fault may be charged where supported by evidence and legally attributable to the customer’s actions. Normal mechanical failure and ordinary wear and tear are not automatically charged to the customer.
- If the vehicle is lawfully stopped or impounded due to a violation attributable to the customer, the customer must cooperate with the authorities and bear the legally recoverable fines and costs attributable to that violation.
- The customer must not conceal an accident, abandon the vehicle, or open, modify, dismantle or repair it without MK Rides’ permission, unless immediate action is necessary for safety or required by law. Any emergency expenditure must be supported by receipts and reported promptly.
- MK Rides and the customer should inspect the vehicle together before handover and record existing scratches, dents, fuel level, kilometres and accessories. Photographs or videos should be taken at handover and return to avoid disputes over pre-existing damage.
